Terms & Conditions Thermometer Arts

Welcome to Thermometer Arts!

We offer our clients a bespoke design service, starting with an obligation-free quotation based on your brief received through any written communication, including Instagram Direct and Facebook Messenger. Upon your acknowledgement of the quotation, you are bound to accept our terms and conditions.

At Thermometer Arts, we reserve the right to refuse any project we consider to be immoral, offensive, obscene, or illegal. Furthermore, we may decline a project if we believe we cannot deliver it to meet your expectations.

We make every effort to meet the estimated duration of your project, although please note that the artwork delivery date is not guaranteed and can vary. Any indication of the project’s duration is an estimation only. Should you have a strict deadline, kindly inform us in advance, and we will do our best to meet it.

Our design charges for services provided by our team are set out in the written estimate or quotation provided in response to your brief. Any additional charges will be based on changes to the initial design brief or the requirement for more drafts or revision rounds than included in the standard package. Upon your acceptance of the quotation, you will be required to make a non-refundable payment of 50% of the quoted fee. The second payment is due after your approval of the final preview of the finished design, and upon receipt, we will provide you with the final files.

The final design or any intermediate designs cannot be used until the full balance is paid.

Should you wish to cancel your order, you may do so at any point and for any reason. Please note that the 50% deposit is non-refundable. However, if you are not satisfied with the final design and require more alterations than included in the price, further work is subject to additional fees.

For cover art and shirt design, we allow up to three initial sketches to approve the concept. Additional initial sketches are subject to an extra fee estimated individually. Once the sketch is approved, we start the implementation process, allowing up to three revision rounds of small alterations that can be implemented within one hour of our designer’s time. For logo design, we allow up to three drafts to approve the style of the logo. Once one is approved as final, we can do up to three rounds of small alterations that can be implemented within one hour of our designer’s time.

The final file with album art is provided in JPG format in high resolution (in most cases, 3000×3000 pixels). On request, we can also send it to you in a format adapted for printing (for example PDF or TIFF). The final file with a logo/emblem is provided in vector EPS format and in raster PNG format on a transparent background. The final file with a shirt design is provided in vector EPS or AI format.

Please note that we do not provide Photoshop project files with the artwork in layers unless agreed upon in advance. As an exception, we can provide you with a PSD file where the album art and logo/title are made in separate layers, so you can change their position in the future. We do not provide files with any source materials used in the process of designing.

At Thermometer Arts, we provide you with exclusive rights, including rights for commercial use, to the artwork designed by our team on your behalf. We retain the rights to utilize artwork and all design elements for portfolio/self-promotion as well as displaying it at presentations, workshops, and galleries. Commissioned artworks are never provided to third parties or used for commercial purposes.

All pre-made designs are offered for licensing with exclusive rights, including rights for commercial use. Each design can be licensed by one client only. We retain the rights to utilize artwork for portfolio/self-promotion.

By placing an order and paying a deposit for design and/or any other services offered by Thermometer Arts , by email, verbally or in writing, you express your acceptance of these terms and conditions.
